Please read these Terms and Conditions carefully before using the https://www.somerbosch.co.za website (the “Service”) operated by Somerbosch Wines (“us”, “we”, or “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms.
The content of this website is and remains the intellectual property of Somerbosch Wines and any of our third-party solution providers. No content may be copied, modified or used without prior consent. Somerbosch Wines presents this content “as is” and warrants that the greatest care has been taken that the content is accurate and up to date. The content of this website is presented “as is” and therefore no additions or deviations from this content by any party will be accepted or approved.
These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa. Please refer to Electronic Communications and Transactions Act 25 of 2002 and the POPIA Act of 2021. These terms and conditions shall be deemed to have been concluded in Somerset West, Western Cape, Republic of South Africa and shall be interpreted according to the laws of the Republic of South Africa. The client consents to the jurisdiction of the Magistrates Court of Cape Town in terms of the provisions of Section 45 of Act 32 of 1944 (including all amendments).
We may change any of these Legal Terms without any notice. The terms and conditions in effect at the time you place your order will apply to that order, even if we change these terms and conditions later.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
All products displayed on the website are subject to availability. We reserve the right to refuse any order you place with us.
We may also limit quantities of certain products or cancel an order if the product information or pricing is inaccurate. We will notify you by email or phone if such a situation arises.
An order is considered complete only after we have received confirmation that the funds have been successfully captured for your chosen payment method.
We accept the following payment methods: Netcash (Online Payment with all methods offered) and by special arrangement only, Direct EFT payments.
All prices listed on our website are in South African Rand (ZAR) and inclusive of Value Added Tax (VAT) at a rate of 15%.
We reserve the right to change prices for our products at any time without prior notice.
In addition, we reserve the right to cancel orders due to unforeseen pricing or stock issues. We will do our best to notify you as soon as possible of such a cancellation and provide a full refund for any cancelled order.
We offer nationwide delivery within South Africa. Shipping costs are calculated as follows:
Free Delivery: Orders with a subtotal exceeding R1500 will qualify for free delivery. (Surcharges are not covered and will have to be paid by you.)
Local Deliveries (Cape Town Area): A flat rate of R50 applies to orders with a subtotal below R1500 and delivered within the Cape Town area.
National Deliveries: A flat rate of R170 applies to orders with a subtotal below R1500 and delivered outside the Cape Town area.
Outlying Area Surcharge: For deliveries to outlying areas (e.g. game farms, mines, farms etc.), an additional surcharge may apply regardless of the order value. We will contact you via email or phone to discuss the surcharge after your order confirmation and payment processing. You will have the option to cancel your order if you do not approve of the surcharge.
If the delivery address is unattended at the time of delivery and the delivery cannot be completed for any other reason, the courier may leave a calling card so you can contact the courier. The products will be stored for a maximum of 7 days. Should the wine products be returned to Somerbosch Wines, any further delivery attempts will be at your own cost.
Our products are insured until the delivery has been completed. Estimated shipping is 3-7 working days once funds have been received.
If you are dissatisfied with your order or the quality of our products, you can return the items for a full refund within 14 days of delivery completion.
However, please note the following:
We reserve the right, at our sole discretion, to modify or replace these Terms at any time, and will indicate the date last updated for public access. If a revision is material, we will try to provide notice prior to any updated terms taking effect but cannot guarantee a notice period due to the changing environment and our products being supplier dependent. What constitutes a material change will be determined at our sole discretion.

You may be required to register in order to be granted access to certain information, services and/or products at this website. This is needed for positive identification to deliver a quality service to our clients.
